Legal basis for participation in the Promotion

1. COMPANY ORGANIZING THE PROMOTION

BIO DARMA, S.L. (hereinafter "the Organization") with registered office at Polígono Industrial Finca Lacy, C / Envelope, 18, 03600, Elda (Alicante), and CIF No B-54471719, organizes for promotional purposes the draw for 2 lots of 6 products (hereinafter "the Promotion") free of charge and nationally, to develop through the Internet, exclusively for users residing in Spain and of legal age in accordance with the provisions of the section on conditions for participation.

VALIDITY OF THE PROMOTION

The Promotion will start on March 2, 2021 on Instagram and on March 10, 2021 on Facebook, ending in both cases on March 16, 2021 at 10:00 a.m. (Spanish peninsular time).

The requirements for participation are as follows:

- Participation is open to those who reside in Spain and are over 18 years of age.

- Only participants with a personal profile on the social network may participate. Facebook e Instagram and are followers of biodarma's official profile on the social network in which they participate.

- The personal data provided by participants must be truthful.

- Participants must follow the instructions indicated in the sweepstakes.

The mechanics of the promotion is to follow biodarma and interact with the publication of the sweepstakes.

- The Organization reserves the right to withdraw from the Promotion any participant that it considers does not comply with the theme or content proposed under section 3.

- Participants are expressly prohibited from participating in the Promotion if their comments infringe upon: (1) the protection of children, youth and women; (2) invade or harm the privacy of third parties; (3) induce, incite or promote any type of criminal, denigratory and/or violent actions in any form; (4) incorporate violent or pornographic messages, (5) are carriers of viruses or any other computer code, files or programs designed to interrupt, destroy or limit the operation of any software, hardware or telecommunications equipment.

- Likewise, the Organization will remove from the Promotion any user who, in accordance with the applicable legal provisions, infringes through his/her participation the intellectual and industrial property rights and other analogous rights of third parties or any regulations governing civil, criminal or any other type of law.

- Employees of biodarma will not be able to participate in the promotion.

- Spaniards who are not residents in Spain and foreigners who do not have a residence card are not eligible to participate.

- The participant is responsible for providing correct information. If due to a defect in the information provided at the time of participation and/or the Organization could not verify compliance with the requirements of the Promotion and/or contact the winner, the company organizing this promotion is exempt from any liability. If the participant provides any false, inaccurate, obsolete or incomplete information, or if the Organization has sufficient reason to suspect that the information provided is false, it shall have the right to withdraw the participant from this promotion, even if he/she is a winner.

- Among all participants who meet the requirements of the Promotion, 2 winners (one on Facebook and one on Instagram) and alternates will be chosen on March 16, 2021 through a random selection platform.

- The winners will get as a prize: 1 lot of 6 biodarma products. The prize includes a shipment of the prize to the address indicated by the winner within the Peninsula. The prize does not include the costs/expenses of accommodation, meals, etc. or any other expenses not expressly provided for in these rules. Under no circumstances may the prize be exchanged, altered or compensated for another. The winner may not sell, resell, auction or carry out in general any type of act involving the commercialization of the prize or products won.

- The Organization will contact the winners by direct message through the comment made by the user in the publication of the draw. The winners must reply by providing biodarma: full name and surname, date of birth, ID number, and postal address for shipping.

- In case of manifest impossibility to contact the winners within 24 hours, the Organization will be exempted from any responsibility and the prize will be awarded to the first alternate and successive winners, who will have 4 hours to accept the prize. In the event that the winners do not accept the prize or do so outside the period established in the previous paragraph, they will automatically lose their right to receive the prize, with no right to claim. Those who are found not to comply with any of the requirements and conditions established in these rules of the Promotion will not be entitled to receive the prize either. Winners must show their ID card when they receive the prize in order to be identified. Likewise, a public publication with the name and profile photo of the winners and alternates may be made on the official profiles or other websites of the organizer to communicate the winner of the Promotion. In addition, at the time of collecting the prize, a photograph may be taken of the winner which may be published on biodarma's social profiles.

By way of example, but not limited to, biodarma is not responsible for computer failures and/or temporary interruptions of service, the presence of viruses or other elements that may affect the Internet service, Facebook and/or email, as well as possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this promotion. We are also not responsible for the use made by the participant with respect to the prize obtained from this Promotion. We are not responsible for the damages caused by the comments made by the participants in the Promotion, and that at any time could hurt the sensitivity of other participants. We do not assume responsibility in cases of force majeure or fortuitous event that could prevent the realization of the Promotion or the total or partial enjoyment of the prize.

The promotion is not sponsored, endorsed, administered by, or associated in any way with Facebook or Instagram and Participants release Facebook and Instagram from any and all liability for any damages arising from the promotion.

With the entry into force of the General Data Protection Regulation (EU) we inform you that BIO DARMA, S.L. treats your data in order to keep you informed of its activity.

We inform you that the legitimate basis for the processing is the fulfillment of the contractual relationship, the consent given at the time and, failing that, the legitimate interest in sending information related to the Organization. biodarma will keep your personal data confidential, communicating it, if necessary, to the authorities in order to comply with its legal obligations.

Your data will be kept in our systems, as long as you do not delete your data or object to the processing of your data.
